IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR CRIMINAL REVISION APPLICATION NO.106 OF 2024 Master Shivin s/o Akshaj Kalbande Vs.

Akshaj s/o Uday Kalbande -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Mr. C. B. Dharmadhikari, Counsel for the applicant. Mr. A. G. Hunge, Counsel for the respondent.

CORAM : URMILA JOSHI-PHALKE, J.

DATED : 07/08/2025 1.

By this revision application, the applicant has challenged the order of interim maintenance granted at the rate of Rs.5,000/-, on the contention that the learned Family Court, Nagpur has granted the maintenance which is very lowest one without considering the income of the respondent. Both parties have submitted that now the trial is already begun and it is fixed for the evidence. The applicant has already adduced the evidence. On perusal of the entire documents, it reveals that except one letter, there is nothing on record to show the exact income of the present respondent. After all, it is a matter of evidence and the applicant has to establish that the respondent is getting sufficient amount, therefore, at this stage, without interfering with the order of the Family Court, it would be appropriate to direct the Family Court to decide the matter expeditiously.

(2) 921.revn.106.2024 2.

In view of that, the revision application is disposed of with the direction that the Family Court No.2, Nagpur, shall decide the Petition No. E-192/2023 expeditiously.

3.

With this direction, the revision application is disposed of.
