Heard.

The applicant is arrested on 7th June, 2017 in connection with crime registered against him for offence punishable under Sections 376, 313, 315 and 316 read with Section 34 of the Indian Penal Code.

The crime is registered on the complaint of Sau. Kunda Naitam that co-accused Sachin assuring to marry her, sexually exploited her and when she developed pregnancy Sachin alongwith present applicant and co-accused Kailas illegally got the pregnancy terminated.

The learned Advocate for the applicant has submitted that the applicant is falsely implicated. It is pointed out that co-accused Sachin is released on bail as per the order passed by this Court in Criminal Application (BA) No.594/2017 on 4/7/2017 and the non-applicant has not been able to point out that custody

2 ba607.17 of the applicant is required for investigation. The applicant, aged about 52 years, claims to be working as Teacher in school administered by Zillah Parishad, Warvhi, Kurkheda and has stated that he is not involved in any other crime / offence.

Considering the facts of the case, following order is passed:

The applicant having been arrested in connection with Crime No.21/2017 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.25,000/- (Rs. Twenty Five Thousand) and furnishing one solvent surety in the like amount. The application is allowed in the above terms. JUDGE Tambaskar.
