The applicant is arrested on 20th May, 2016 in connection with crime registered against him for the offences punishable under Sections 14(a), (b) & (c) of the Foreigners Act, 1946 on the accusations that he being not an Indian national ought to have left India before expiry of his VISA on 19th November, 2014, however, he overstayed without there being valid VISA.

The applicant has stated that he has married with an Indian woman on 18th September, 2013 and has applied for extension / renewal of VISA. It is stated that no other crime/ offence is registered against the applicant. The learned advocate for the applicant has stated that if the applicant is released on bail his wife and in-laws would stand surety for him.

Considering the facts of the case and the nature of accusations against the applicant, following order is passed:

2 ba609.17 The applicant, having been arrested in connection with Crime registered vide F.I.R. No.0279 of 2017 by the nonapplicant, he be released on bail on executing P.R. Bond for Rs.Twenty Five Thousand and furnishing two solvent sureties in the like amount, out of which one surety shall be furnished by Deepali Yashua Meshiach Lebowitz (wife of the applicant) and other surety shall be furnished by Budhram Bishnath Lohra (father-in-law of the applicant).

The applicant shall attend Police Station, Gittikhadan, Nagpur on every Wednesday between 11.00 a.m. and 1.00 p.m. and give information about his whereabouts and shall intimate the Police Station Officer further progress about his case regarding extension/ renewal of VISA.
