O R D E R

(SEPTEMBER 09, 2017) The parties to the first appeal and the respective counsel have tendered a compromise pursis in Form-H in the Lok-Adalat, today. The compromise pursis is signed by the Executive Engineer for the V.I.D.C. and their counsel Shri V.G. Palshikar. It is also signed by the witness to the signature of the Executive Engineer. The compromise pursis is also signed by the respondent nos.1 and 2. The respondent nos.3 and 4 have affixed their thumb impression on the compromise pursis. Mrs.Neeta Jog, the learned counsel for the respondent nos.1 to 4, states that she has explained the contents of the compromise pursis, which is in English language, to the respondent nos.3 and 4, who are present in the Lok-Adalat. The compromise pursis is also signed by Shri Kadu, the learned Assistant Government Pleader for the respondent no.5.

We have perused the terms of the compromise pursis. They are just and reasonable. The parties have stated that they have agreed on the terms of the compromise with their free will. It is stated in the compromise pursis that apart from withdrawing the amount that was already deposited by the appellant-Corporation, the appellant-Corporation would pay an additional amount to the respondent nos.1 to 4 jointly to the tune of Rs.8,59,946/- within six months from this date. It is stated in the compromise pusis that the said amount would be deposited in the joint account of the respondent nos.1 to 4 through R.T.G.S. or N.E.F.T.

FA975-10 Since we find that the terms of the compromise are just and reasonable, the first appeal is disposed of in terms of the compromise pursis. A decree be drawn accordingly.
