Shri A.J. Pophaly, Advocate for the appellant / insurance company states that this appeal, filed to challenge the interim award passed by the Motor Accident Claims Tribunal under Section 140 of the Motor Vehicles Act, 1988 has become infructuous as the claim petition itself is decided. It is further submitted that the amount as per impugned award was deposited and has been withdrawn by the claimants. In view of the above facts, the appeal is dismissed as infructuous.
