CORAM : A NIL S. KILOR , J.
DATED : OCTOBER 10, .
1.
On 30/08/2019 notice was issued to the respondent for final disposal. However, the applicant failed to serve the respondent till 11/07/2022 i.e. for almost three years and therefore, fresh notice was issued by this Court. The applicant was also permitted to serve the non-applicant by Registered Post Acknowledgment Due (RPAD) in addition to regular mode of service. 2.
Thereafter, when the matter was listed on 29/08/2022, the learned counsel for the applicant undertakes to remove the office objections within two working days. However, he again failed to supply copy for service to the non-applicant.
3.
On 19/09/2022 the applicant was again directed to supply copy for service, however, the applicant has not supplied copy for service to the non-applicant and even he has not filed any acknowledgment as regards service by RPAD on the non-applicant.
2 37-APL678-2019 4.
From the above noted facts, it can be seen that since more than three years, the applicant has failed to take necessary steps to serve the non-applicant. Thus, it is clear that the applicant is not interested to pursue the present matter.
Hence, the Criminal Application is dismissed for want of prosecution.
