Heard.

This is an application filed by the applicant/wife under Section 24 of the Code of Civil Procedure, 1908 for transfer of H.M.P. No.

114/2019, which is pending on the file of the Civil Judge, Senior Division, Bhusawal, District - Jalgaon to the Court of the Civil Judge, Senior Division, Warora, District - Chandrapur.

In spite of due service, the respondent chose not to appear before this Court, which indicates that he is not interested in opposing the application.

Transfer is sought on the ground that the applicant is an unemployed women, presently residing at the mercy of her parents, and that she is finding it difficult to travel to Bhusawal to attend the proceedings filed by the respondent, as the distance

26MCA 676.19 between the place where she is residing and Bhusawal is around 445 kilometers.

In such cases, convenience of wife is to be seen.

Accordingly, this Court is inclined to allow the application, and it is accordingly allowed. H.M.P. No. 114/2019, which is pending on the file of the Civil Judge, Senior Division, Bhusawal, District - Jalgaon is withdrawn and transferred to the Court of the Civil Judge, Senior Division, Warora, District - Chandrapur.

The interim relief granted by this Court vide order dated 05/07/2019, stands vacated.

The Civil Application accordingly stands disposed of.
