CORAM :- A.S.CHANDURKAR AND URMILA JOSHI-PHALKE, JJ. DATE :- SEPTEMBER 05, 2022 The petitioner seeks appointment on compassionate basis. His claim has been turned down on the ground that he has completed the age of 45 years.

In the affidavit in reply filed on behalf of the respondent no.2-Divisional Commissioner, Amravati it has been stated in paragraph 6 as under:

"6. It is submitted that according to the petitioner, his date of birth is 13.06.1975 and he has completed the age of 45 years on 12.06.2020. At this juncture it is to be noted here that the answering respondent by communication dated 23.09.2020 has issued the guidelines to the Zilla Parishad, Yavatmal wherein it was made clear that a candidate claiming appointment on compassionate grounds and who had completed the age of 45 years is eligible for the appointment, only if the initial process or the application made by such candidate is made prior to completion of his/her age of 45 years."

There is no reply filed on behalf of the Zilla Parishad despite grant of time. To grant one opportunity to the respondent nos. 4 and 5 to file their affidavit in reply, stand over to 19.09.2022.

29-WP-1124-21.odt 2 CIVIL APPLICATION (W) NO. 1917 OF 2022 Since the petitioner seeks to carry out certain corrections in the Annexures annexed to the writ petition, the application is allowed in terms of prayer clauses (1), (2) and (3) thereof.

The civil application is disposed of.
