The learned counsel for the applicant/Insurance Company requested for deletion of name of respondent No.6-Durpatabai on her death as per Bailiff report. It appears that Durpatabai was mother of the deceased Manohar who died in the accident. The other dependents are already on record. As such the name of Durpatabai i.e. respondent No.6 be deleted forthwith. 2.

Heard rival submissions.

The first application i.e. the Civil Applicaion No.1034/2024 is filed for condonaiton of delay of 208 days in filing Misc. Civil Application (ST) No.10851/2024 for setting aside the order dated 04.10.2023 and to restore the First Appeal No.1082/2013.

Though the respective learned counsel for the nd.thawre

respondent No.1, respondent No.2 and respondent Nos.3 to 5, opposed the application, but since the learned counsel for the applicant/Insurance Company is ready to file the paper book within two weeks, both the applications stand allowed in terms of their respective prayers. 5.

The First Appeal No.1082/2013 is hereby restored to its original stage.

Stand over to 18.02.2025.

7.

The interim relief granted under order dated 27.09.2013 to continue in the meantime.
