DATE : 20th April 2017 PER COURT 1, Proceedings No.A-522/2016 are initiated before the Family Court, Pune by the non-applicant husband under the provisions of Section 13 (1) of the Hindu Marriage Act for divorce. The transfer of the said proceedings is sought from Family Court, Pune to Family Court, Nagpur.

Claim is opposed by learned Counsel for the respondent on the ground that as the cause has arose at Pune, the proceedings are rightly maintainable at Pune. According to her, application needs to be dismissed even on merit.

Considering the rival contentions, what is required to be noted that the convenience of the wife is to be considered. The applicant is residing at Nagpur and according to her, it will be convenient for her if the proceedings are transfered to Nagpur, which in my opinion, required to be considered.

As such, Miscellaneous Civil Application stands allowed in terms of prayer clause (i). Hearing expedited.
