C.A.(W) No. 1681 of 2018 in W.P. No. 2387 of 2018 Coram : Registrar(Judicial) Dated : 20 th July, 2018 This application is filed for issuing of fresh notice and for extending the returnable date. It is stated in the application that Hon'ble Court was pleased to grant Hamdast for service of notice to the respondents returnable on 12.06.2018. It is further submitted that since the petitioners could not deliver the Hamdast at Small Causes Court before 12.06.2018, the notice could not be served on the respondent nos. 2 to 5 and when the matter was listed on returnable date i.e. on 12.06.2018, it was listed for orders for await notice. Therefore, the applicant/petitioner prays to issue fresh notice and extend returnable date. The counsel states that since the contents of the instant application being formal in nature, the affidavit may kindly be dispensed.
Since the application is formal in nature, the same is allowed. Issue fresh notice to the respondent no.2 to 5 on given address, returnable within four weeks.
