Shri Patil, learned counsel for petitioner submits that respondent no.1 sought voluntary retirement in 2002 and accepted the retiral benefits as per pay fixation order dated 14.6.1999. It is also submitted that no recovery has been made from respondent no.1.

In view of the above, cause for the petition does not survive. Writ Petition has become infructuous. Hence, disposed of. No costs.
