The applicant is arrested on 2nd September, 2016 in connection with Crime No. 573 of 2016 registered against 16 accused (including the present applicant and a juvenile) for the offences punishable under Sections 302, 364, 143, 147, 148, 149, 120-B of the Indian Penal Code and Sections 3/25 and 4/25 of the Arms Act on the accusations that they have conspired and attacked the victim and murdered him. The learned advocate for the applicant has pointed out that co-accused Anand @ Bunty alleged to be the mastermind and main accused is released on bail as per the order passed by this Court on Criminal (BA) No. 1111/2016 on 10th February, 2017. It is further pointed out that coaccused Vikas, Atul, Nitin, Abhishek, Shubham, Dhamendra and Anand are also released on bail. It is submitted that as far as the applicant is concerned, no overtact is attributed to him and according to the Investigating Agency he had been working with the deceased but had been in touch with the accused and passing information to the accused.

2 ba612.17 The applicant, aged about 24 years, claims to be a labourer and has stated that he is not involved in any other crime/ offence.

The charge-sheet is filed on 25th November, 2016. The non-applicant has not been able to point out that custody of the applicant is required for further investigation. In the facts of the case, following order is passed: The applicant, having been arrested in connection with Crime No.573 of 2016, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Fifty Thousand and furnishing one solvent surety in the like amount.
