The petitioner was working as Constable in 29th Battalion, Central Reserve Police Force. He was dismissed from service by an order dated 25.01.2010 after conducting departmental enquiry. Departmental Appeal is also dismissed. The main charge was overstaying for more than 273 days, which has been held to be proved. The petitioner has earlier filed Writ Petition No.1754 of 2017 and that was withdrawn without leave of the Court.

Therefore, we do not find any reason to entertain this Writ Petition on the ground of delay and the principles contained in Order XXIII Rule 1 of the Code of Civil Procedure.

The Writ Petition is dismissed.
