In the present petition, the contempt is alleged for non compliance of judgment and order dated 29.6.2020 passed by the University and College Tribunal, Nagpur. 2.

According to the judgment of learned University and College Tribunal, the Management was directed to recall the termination order dated 15.12.2011 and reinstate the petitioner with continuity of service on the post of Clerk from open category.

Along with this, the Principal of the College was directed to send fresh proposal for correction in approval to the office of Director, Department of Social Welfare and the Director was further directed to correct the approval suitably, expeditiously.

The learned counsel for the petitioner states that he has been reinstated and continuity of service is also granted. However, he raised a grievance that he was not paid the backwages and pay fixation is not done as per the existing pay-scale.

The present respondents stated that as he has been reinstated with continuity of service, as a consequence of the same, pay fixation will be done in the matter. The learned counsel for the respondents stated that in the judgment and order of University and College Tribunal, there was no direction to pay the back-wages to the petitioner. Hence, according to them, the entire compliance of the judgment of Tribunal is done in the matter. This fact is not disputed by petitioner in the matter.

In view of above said submission, it is clear that the respondents have purged the contempt.
