Heard learned counsel Mrs. I.P. Khisti for the applicant-appellant.
By these applications, the applicant prays for condonation of delay of 32 days in filing the application for restoration of the first appeal to which registration was refused for non-removal of office objection.
Learned counsel Mrs. I.P. Khisti for the applicant-appellant submits that inadvertently the matter was not marked and subsequently it was noticed that the registration of the appeal was refused for non-removal of office objection. Meanwhile, the file was misplaced. After receiving the necessary papers, the application is immediately filed seeking restoration .....2/-
of the appeal. There was delay of 32 days. Learned counsel further submits that the office objection would be removed within shortest possible time, if this Court grants the time. Learned counsel has raised substantial grounds in challenge to the order of the Reference Court seeking just and fair compensation.
In view of the submissions made by learned counsel Mrs. I.P. Khisti for the applicant-appellant, the delay is condoned and the appeal is restored to its file subject to removal of the office objection(s), within a period of three weeks from today.
The civil applications are disposed of as such.
