The applicant is arrested on 15th May, 2017 in connection with Crime No.152 of 2017 registered for the offence punishable under Section 307 of the Indian Penal Code.

The crime is registered on the complaint lodged by Mithailal Sevakram Bisne that the applicant picked-up quarrel with the complainant alleging that a girl name Rani Kamble (relative of the applicant) had eloped with the nephew of the complainant and took out a knife from his pocket and assaulted the complainant causing injuries on his head, forehead, right cheek, stomach and finger of left hand. The application is opposed on the ground that the applicant is habitual offender and Crime No.40 of 2004, Crime No.156/2003, Crime No.3061/2004 and Crime No.192/2007 for various offences under the Indian Penal Code are registered against him and prosecutions are pending.

2 ba616.17 The learned advocate for the applicant has submitted that since last 10 years the applicant is not involved in any other crime/ offence.

Be that as it may, the non-applicant has not been able to point out that custody of the applicant is required for further investigation.

In the facts of the case, following order is passed. The applicant, having been arrested in connection with Crime No.152 of 2017, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Twenty Five Thousand and furnishing one solvent surety in the like amount.

The applicant shall attend the trial before the Sessions Court regularly on every date unless granted exemption by the Sessions Court.
