In view of the inability expressed by the appointed Arbitrator Shri Justice R.G. Deshpande (Retd.) to continue with the assignment, the applicant is seeking appointment of substitute Arbitrator.

Mr. G.V. Moharir, the learned counsel who is appearing on behalf of the respondents states that formal Vakalatnama shall be filed during the course of the week. Mr. G.V. Moharir further states that the respondents have no objection if Hon'ble Shri Justice B.P. Dharmadhikari (Retd. Chief Justice of Bombay High Court) is appointed as the sole Arbitrator. Mr. Chari who appears on behalf of the applicant consents to appointment of the Hon'ble Shri Justice B.P. Dharmadhikari as the sole Arbitrator. 3.

The Hon'ble Shri Justice B.P. Dharmadhikari is

The registry shall issue letter of request to Hon'ble Shri Justice B.P. Dharmadhikari requesting him to forward the statement of disclosure and consent. 5.
