NAGPUR BENCH, NAGPUR WRIT PETITION NO. 4283/2016 (Sachin Shantil Khatri vs. Union of India and others) .............................................................................................................................................. Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders .............................................................................................................................................. Ms. S.V. Upadhyay, Advocate for the petitioner. Mr. A.A. Madiwale, Asst. Government Pleader for respondents Nos. 2, 3 and 4 CORAM : SMT. VASANTI A NAIK & MRS.SWAPNA JOSHI, JJ.

DATED : 28th July, 2016 Heard.

By this Writ Petition, the petitioner seeks a direction against the respondents to monitor the advertisements that are exhibited on various television channels and direct the respondents to discontinue the advertisements of 'Shubhlaxmi Kuber Yantra'.

It is stated on behalf of the petitioners that by making advertisements of Shubhlaxmi Kuber Yantra, a false assurance is given by the respondent nos. 9 and 10 to the public that wealth would come their way if they purchase the Shubhlaxmi Kuber Yantra. It is stated that when the Government is required to implement the Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practice and Black Magic Act, 2013, the State

Government is expected to monitor the advertisement on the television channels, especially the advertisements of Shubhlaxmi Kuber Yantra, as it is apparent that on the purchase of Shubhlaxmi Kuber Yantra, a person may not receive money. It is stated that the respondent nos. 9 and 10 are cheating the public by issuance of such advertisements.

We are not inclined to entertain the petition in exercise of the writ jurisdiction. Prima facie, the advertisements of Shubhlaxmi Kuber Yantra would not be a matter which can be looked into by the State Government under the Prevention and Eradication of Human Sacrifice and other Inhuman Evil Aghori Practice and Black Magic Act, 2013. If the petitioner is of the view that the respondent nos. 9 and 10 are cheating the public by issuing advertisements of Shubhlaxmi Kuber Yantra, the petitioner has other remedies. The petitioner is free to exhaust those remedies, if the petitioner desires that the Government authorities including the law enforcing agencies should take some action against the respondent nos. 9 and 10. In the circumstances of the case, we dismiss the Writ Petition, with no order as to costs. JUDGE JUDGE sahare
