DATED :- AUGUST 14, 2024 Apprehending the arrest at the hands of police in connection with Crime No.186/2023 registered with Police Station Sonegaon, Nagpur for the offences punishable under Sections 420, 465, 468, 471 and 120-B read with Section 34 of the Indian Penal Code, the applicant approached this Court for grant of pre-arrest bail.

The allegation against the present applicant is on the basis of report lodged by Umesh Nanaji Kakde alleging that he was in a search of job and the co-accused promised him for providing the job and accepted the amount from him of Rs.3,00,000/- and issued the forged appointment letter and thereby he was duped by the other co-accused. As far as the present applicant is concerned, the allegation is that he was working with the accused No.5 Pankaj Vairagade and accepted the documents from the complainant and also made a phone call to the complainant to join the job.

Learned Counsel for the applicant submitted that as far as the present applicant is concerned, who is working with the accused No.5 and he has only obeyed the order of his master. He submitted that the other co-accused are already released on bail by this Court by granting them protection. As far as present applicant is concerned he has neither accepted the amount nor any role is played by him in a forgery. In view of that, he be protected by granting ad-interim protection.

Learned APP strongly opposed the said application and submitted that during investigation the involvement of the present applicant is revealed. He in connivance with the other co-accused has duped the informant. In view of that, his custodial interrogation is required.

After hearing the learned Counsel for the applicant and learned APP for the State, perused the investigation papers from which it reveals that the applicant was working with one Pankaj Vairagade and while obeying the order of his master he has accepted some documents and the amount. As far as the present applicant is concerned his custodial interrogation is not required. In view of that, the interim protection granted to the applicant vide order dated 15/07/2024 deserves to be confirmed.

Hence, the application is allowed. The interim protection granted to the applicant vide order dated

15/07/2024 is hereby confirmed on the same terms and conditions.

The applicant shall attend the concerned police station once in a week i.e. on every Sunday between 10.00 a.m. and 1.00 pm. till filing of the charge-sheet and shall cooperate with the investigating agency.

The applicant shall furnish his Cell phone number and address with the address proof.

The application is disposed of.
