CORAM : SMT. VASANTI A NAIK AND MRS. SWAPNA JOSHI, JJ.
DATED : AUGUST 02, 2016.
By this civil application, the applicant-petitioner seeks a direction to the respondent no.3 to declare the result of the petitioner and to admit the petitioner in the next semester. It is stated on behalf of the petitioner that the caste claim of the petitioner is still pending and this court had directed the scrutiny committee, by an order dated 28.4.2016, to decide the caste claim within one year. It is stated that the respondent no.3 is not declaring the result of the petitioner and not permitting the petitioner to take admission in the next semester. In view of our order, it would be necessary for the respondent no.3 to protect the education of the petitioner till the caste claim is decided. The petitioner is ready to pay the fees that are liable to be paid by the regular-general category students till his caste claim is decided.
In this background, the respondent no.3 may declare the result of the petitioner and permit the petitioner to take admission in the next semester on the condition that the petitioner deposits the fees that are liable to be deposited by the general and open category students. It is needless to mention that if the caste claim of the petitioner is validated, the
2 caw1547.16.odt respondent no.3 would be required to refund the excess fees that are received from the petitioner in terms of this order. The civil application is disposed of in the aforesaid terms. JUDGE JUDGE Gulande, PA
