Heard Shri M.K. Mishra, learned counsel for the petitioner.

In the absence of any document showing 9 meter wide road duly sanctioned by the authorities and considering the nature of dispute, we find that it needs to be raised in Civil Court where dispute between neighbours can be appropriately resolved.

Hence, without observing anything on merits of the controversy, we grant the petitioner liberty to approach the Civil Court. Writ Petition is accordingly disposed of. No order as to costs.
