Apprehending arrest in connection with crime registered for the offence punishable under Section 306 read with Section 34 of the Indian Penal Code, applicant seeks pre-arrest bail.
According to the Investigating Agency, Mahesh Patil (deceased) had taken loan from Bajaj Finance and he failed to repay the installments and therefore, the applicant, who is working as Executive of Bajaj Finance and co-accused Sachin harassed and tortured Mahesh Patil because of which he has committed suicide. The Investigating Agency relies on note alleged to have been left by Mahesh Patil. The applicant, aged about 37 years, claims to be working with Bajaj Finance and has stated that he is not involved in any other crime/offence. The copy of say filed by the Investigating Agency before the Sessions Court is placed on record. Except for general accusations against the
2 aba478.17 applicant for opposing the bail, there is nothing on record on the basis of which it can be said that the Investigating Agency requires custody of the applicant for further investigation.
Considering the nature of accusations against the applicant and the facts of the case, following order is passed: In the event of arrest in connection with Crime No.247 of 2017 registered by the non-applicant, the applicant be released on bail on executing P. R. Bond for Rs.50,000/- and furnishing two solvent sureties in the like amount. The application is allowed in the above terms. JUDGE PBP
