The Investigating Officer Shri Mahesh Krushnarao Chavhan is present before this Court. After hearing the learned counsel for the parties for sometime, when this Court expressed its mind, not to pass favourable order, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to move this Court again after one year. Leave as prayed for is granted with liberty to move the application afresh before this Court, if within one year there is no effective hearing (i.e. framing of charge, evidence etc.) commenced in the trial before the trial Court. However, it is made clear that the applicant / accused person shall not be at fault in delaying the trial for any reason whatsoever.
The criminal application is disposed of as withdrawn accordingly.
