IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO.4340 OF 2023 (Priti d/o Arunrao Tasare (Priti w/o Charudatta Dhole) Vs. Chief Executive Officer, Zilla Parishad, Amravati) ------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoramda of Coram, appearances, Court's orders of directions Court's or Judge's orders.

and Registrar's Orders.

------------------------------------------------------------------------------------------------------------------------------------- Mr. P. R. Agrawal, Advocate for Petitioner.

Mr. M. G. Rathi, Advocate for Respondent.

CORAM: ANIL S KILOR , J.

DATE: 13 th SEPTEMBER, .

The present matter relates to transfer of the petitioner from District Health Office, Amravati to Sub Centre Amzari of PHC Salona.

2.

The learned Industrial Court while deciding the application for grant of stay to the transfer order dated 03.07.2023, rejected the application.

3.

Admittedly, the petitioner was transferred on 12.05.2023 and though there was a status quo the respondent did not allow her to work at Amravati on the ground that before the order of status quo she was relieved. Thus, from last more than four months technically there is no interim protection in favour of the petitioner. 4.

In that view of the matter, I am of the opinion that the ends of justice would be sub-served if the Industrial

wp4340.23.O.odt Court is directed to decide the complaint within one month. 5.

Both the parties are agreeable to the same and accordingly the writ petition is disposed of without entering into the merits of the matter, keeping all the points open. 6.

The Industrial Court shall decide the complaint ULP No.60/2023 within one month from today.

7.

Considering the fact that the status quo order was granted by the Industrial Court and further no one has been transferred in place of the petitioner, the respondent shall not take any coercive action till the final decision in the complaint.
