The petitioner makes a grievance that the respondent No.1 has not decided the proposal of his premature release by categorization. It appears that the petitioner came to be convicted by learned Additional Sessions Judge, Gondia for the offence punishable under Section 302 of the Indian Penal Code in Sessions Trial No.84/2008 on 7th March, 2011. This Court dismissed the appeal filed by the petitioner i.e. Criminal Appeal No.199/2011 on 16.04.2014. Therefore, it is necessary to decide the categorization of the petitioner.

Ms. N. R. Tripathi, learned APP waives notice for respondent Nos.1 and 2/State and makes submissions that it can be decided within eight weeks.

In view of the said statement and taking into consideration the fact that the proposal is stated to be pending since 2020, we dispose of the petition by giving directions to the respondents to decide the categorization and the proposal within a period of eight weeks from today.
