The applicant is apprehending arrest in Crime 495/2020 registered with Sakkardara Police Station, Nagpur for offences punishable under Sections 419, 420, 465, 467, 468 and 471 read with section 34 of the Indian Penal Code.

The crime is registered on the basis of report lodged by Mr. Mahesh Dashrath Kotangale-the SubRegistrar of Documents. The gist of the report is that coaccused Rajesh Hande, Mohd. Syed Mohd. Sadique and Abdul Hamid Abdul Salan impersonated as Mr. Dilip Rajurkar and attempted to execute sale-deed of the plot in question in favour of one Sawwalakhe. However, an alert informant suspected the identity of the seller and the authenticity of the identification documents, summoned the police, and the aforesaid three co-accused were arrested on the spot.

The role of the applicant has surfaced in investigation. Perusal of the case diary reveals that the applicant appears to have played an extremely significant role in the alleged crime. It is the applicant who allegedly prevailed on co-accused Rajesh to impersonate as the owner Mr. Dilip Rajurkar. It is the contention of the Investigating Officer and there is material in the case diary to prima facie substantiate the said contention, that it is the applicant who either prepared or procured the false and fabricated identification documents. 5.

Considering the nature of the accusations, custodial interrogation is imperative lest the investigation is rendered directionless.

The application is dismissed.
