The applicant - Pramod Gulab Katankar, is seeking bail in Crime No. 216 of 2020 for the offence punishable under Sections 376(2(n), 354-A and 506 of the Indian Penal Code registered by Railway Police Station, Akola, District - Akola. 3.

The allegations against the present applicant are that he sexually exploited the victim aged 25 years on the pretext of giving her job and to marry her.

The learned counsel for the applicant submits that there was love affair and as he could not marry, the present crime came to be registered. 5.

A perusal of the contents in the FIR do not prima facie make out the case of rape. The girl is aged 25 years while the applicant is aged 28 years. 6.

Considering the nature of allegations made against the applicant, this Court is inclined to grant him bail. Hence, Criminal application is allowed on the following conditions :

(i) The applicant - Pramod Gulab Katankar, shall be released on bail on executing Personal Bond of Rs. 25,000/- (Rs. Twenty five thousand only) with one surety in the like amount.

(ii) The applicant shall not issue threats or tamper the prosecution witnesses.

Needless to mention that the observations made in this application are strictly for deciding the present application of the applicant and the trial Court shall not get influenced by the same and shall be free to decide the matter on its merits. JUDGE *GS.
