ATED : 8th February, 2021 The allegation against the applicant is that he has committed rape on a mentally retarded girl. It is submitted that since 10.11.2018, the applicant is in jail.

After hearing the learned Advocate for the applicant for quite some time, when the Court was disinclined to entertain the prayer for bail, he sought permission to withdraw the instant Application with liberty to file bail application before the Court below, if the trial does not proceed against the applicant within a period of six months. Permission granted. Criminal Application (BA) No. 1241/2020 is allowed to be withdrawn and dismissed as such, with liberty as prayed for.
