This is an application for anticipatory bail since the applicants are apprehending their arrest in connection with Crime No.6136/2015 registered with Police Station, Chamorshi, Dist. Gadchiroli for an offence punishable under Sections 65 (E) and 83 of the Bombay Prohibition Act.

Today, when the matter was taken for consideration, the learned A.P.P. Mr. A.K. Bangadkar, submitted that he has received instructions from the Police Station Officer, Police Station, Chamorhsi, that the applicants are attending the police station and they have already joined the investigation. He further submits that the Investigating Officer has specifically instructed him to make a statement before this Court that the Investigating Officer is not in need of the custodial presence of the applicants.

In view of the above, the application needs to be allowed Hence, following order is passed.

ORDER

(i) Criminal Application No.385/2015 is allowed.

(ii) Applicant no.1-Vikas Nilkanth Mandal, applicant No.2-Prakash Nilkanth Mandal and applicant no.3-Suraj Sukumar Haldar, in the event of their arrested in Crime No.6136/2015, for the offence punishable under Sections 65 (E) and 83 of the Bombay Prohibition Act registered with Police Station, Chamorshi, Dist. Gadchiroli, shall be released on they executing P.R. Bond in the sum of Rs.25,000/- each with one surety each in the like amount.

(iii) Applicant no.1-Vikas Nilkanth Mandal, applicant No.2-Prakash Nilkanth Mandal and applicant no.3-Suraj Sukumar Haldar, shall attend Police Station, Chamorshi, Dist. Gadchiroli regularly till the filing of the charge-sheet.
