In pursuance of our order dated 1.4.2014, the matter was adjudicated by the learned Commissioner and it is held that the applicant would be entitled to a sum of Rs.36,60,000/-. In view of the aforesaid, since an amount of Rs.50,00,000/- has been deposited by the original petitioner in Writ Petition No.4494/2013, the applicant is permitted to withdraw an amount of Rs.36,60,000/- with interest accrued thereon as the amount was placed in fixed deposit account. The original petitioner may be permitted to withdraw the balance amount with the accrued interest.
The civil application is allowed in the aforesaid terms and disposed of.
