Heard learned counsel for the applicant.

It is seen from the First Information Report that this applicant was very much present at the spot and that the complainant, who is a police constable at Wadki Police station, had seen this applicant as present at the spot and was told by the injured truck driver that the persons who were present on the spot had injured him as he refused to meet their demand of money. This applicant, on seeing the police coming to the spot had run away and was given a hot chase by the complainant but in vain. Since then, this applicant has not presented himself before the police to narrate his side of the story. All these facts and circumstances, in my view, show the involvement of this applicant and it cannot be said that the allegations against him are without any basis. The offence as registered against this applicant and others is very serious in nature. There are criminal antecedents to this applicant.

On the whole, I find that this is not a case for grant of anticipatory bail. The application stands rejected. JUDGE Hirekhan
