The applicant/petitioner is not entitled for the relief sought in the civil application because of the wilful default committed by it in complying with the condition imposed by this Court while granting interim order.

The alternate prayer of the petitioner for grant of early hearing is also not required to be considered as the petition is of 2008 and is already on hearing parties board.

The civil application is dismissed.
