Civil Application (F) No.2860/2017:

This is an application filed by the original claimant Nos.1 and 2, for withdrawal of the amount of compensation deposited in the Court. It is submitted that out of the total amount of compensation only 75% of the amount of the award has been deposited and hence, respondent may be permitted to withdraw the entire amount deposited in the Court.

Learned counsel Shri Wankhede appearing for appellant is absent on the last date and today also. Heard learned A.G.P.

Respondent Nos.1 and 2 are permitted to withdraw the entire amount of compensation deposited in the Court subject to condition of furnishing usual undertaking and subject to furnishing solvent surety for 50% of the amount to the satisfaction of the Registrar (Judicial) of this Court.
