It is the prosecution case that the vehicle owned by the applicant was seized with stock of country liquor. It is contended by the applicant that though he is registered owner of the vehicle, he had handed over the said vehicle in the custody of his friend Bablu Mandal, who took the vehicle under the pretext of visiting some place.

It is submitted that already the entire country liquor stock and the vehicle are seized by the police. Upon instructions, learned A.P.P. made a statement that the said Bablu Mandal has

Considering the limited allegations against the applicant, his custodial interrogation is not necessary. In view of that, following order is passed.

(i) Criminal Application is allowed and disposed of.

(ii) The ad-interim order dated 05.10.2021 passed by this Court is hereby made absolute on the same terms and conditions.

(iii) The applicant/accused to continue to attend the concerned police station till the filing of the charge sheet or 60 days, which ever is earlier.

(iv) All pending Misc.

Criminal Application, if any, stand disposed of.
