DATED :- DECEMBER 14, 2024 Learned Counsel for the applicant, on instructions, submitted that the accused has already filed an application for quashing of the proceedings wherein to carry out the investigation is permitted; however, restrained the investigating authority to file the charge-sheet.

The other proceeding i.e. Writ Petition No.724/2022 for seeking directions to enquire about the matter is also pending and Application No.1187/2022 which is filed by the accused challenging the another application filed by the complainant.

He submitted that as all these applications are pending before the Division Bench, he seeks withdrawal of the application with liberty to file afresh if the circumstances arises.

Permission is granted to withdraw the application.
