1] The applicant is apprehending arrest in Crime 204/2018 registered with the Police Station Babhulgaon, Tahsil Babhulgaon, District Yavatmal for offence punishable under section 384 of the Indian Penal Code.

2] The incident allegedly occurred on 06.02.2018. The accusation is that the applicant who claims to be a Journalist, attempted to extort an mount of Rs.8000/- from the complainant. However, the report is lodged nearly after four months after the incident on 03.06.2018. 3] In the interregnum, several complaints are lodged by the applicant against the complainant with the Agricultural Officer, Babhulgaon, District Yavatmal inter alia complaints dated 14.02.2018, 05.03.2018, 22.04.2018 and 14.05.2018. The applicant also approached the Collector, Yavatmal seeking cognizance of the alleged misconduct committed by the complainant who is working as Agricultural Assistant.

aba467.18.O.odt 2 4] In view of the nature of accusations, the grossly delayed F.I.R. and the fact that the first information report is lodged only after several complaints are made by the applicant before the appropriate authorities, I am inclined to allow the application.

5] The interim order dated 29.06.2018 is confirmed with the modification that the applicant shall attend Police Station Babhulgaon, District Yavatmal as and when called upon to do so by the investigating officer.
