The applicant herein has approached this Court seeking anticipatory bail in connection with FIR dated 07.06.2019 registered in Police Station Ramdaspeth, Akola, for offences under Sections 324 and 326 of the IPC.

Since a copy of this application was served in the office of the Government Pleader, the learned AGP has appeared and opposed the present application. 3.

Heard the learned counsel appearing for the rival parties and perused the material on record. 4.

The material presently on record shows that the applicant assaulted the cousin of the complainant with knife on his thigh resulting in serious injury for which the victim had to be referred to Nagpur for further treatment. The FIR was registered on 07.06.2019 and on 04.07.2019 the Sessions Court rejected the anticipatory bail application recording the fact that the investigation is still at primary stage and even the weapon used in the offences is yet to be recovered. The nature of the

ABA442-19.odt offence, the weapon used and the manner in which the assault is said to have been carried out by the applicant, shows that it would be improper to grant anticipatory bail in the present case and that if such relief is granted, it would hamper the investigation.

Hence, the present application is rejected.
