In Writ Petition No. 4395/2016 this Court held the petitioner to be entitled for the benefit of fixation in the pay scale of Rs.12,000 - 18,300 as per recommendations of the Fifth Pay Commission from the date of his appointment and in the pay band of Rs. 37,400 - 67,000 with grade pay of Rs.9,000/- as per recommendations of the Sixth Pay Commission from 01.01.2006 with notional benefit. Further direction was issued that enhanced salary from 01.08.2017 onwards would be admissible without any arrears of the salary.
On 11.01.2021 the document dated 07.10.2019 indicating grant of revised pay-scale and entitlement to that salary from 01.08.2017 was taken on record. Thereafter on 09.12.2019 the necessary orders with regard to pay fixation have been passed by the Joint Director of Education, Nagpur.
It is informed that the petitioner is presently serving at Mumbai and therefore further steps would be taken under the guidance of the respondent no.2.
5.CP202.18.odt 2 Since the order dated 04.08.2017 with regard to revision of pay-scale and entitlement of the petitioner from 01.08.2017 to the pay-scale has been complied with, further steps with regard to disbursement of regular salary and the arrears, if any, from 01.08.2017 shall be looked into by the respondent no.2. Compliance be done expeditiously in the light of the fact that these directions were issued on 04.08.2017.
With these observations, the contempt petition is disposed of.
