IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

WRIT PETITION NO. 4508 OF 2017 (Shri Devangan Dashrathji Nandanwar vs. The State of Maharashtra, thr. its Secretary, Department of Rural Development and Water Conservation & Anr.) _____________________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders.

and Registrar's Orders.

CORAM : B.P. DHARMADHIKARI & MRS. SWAPNA JOSHI, JJ.

OCTOBER 03, 2017.

Heard Shri N.S. Warulkar, learned counsel for the petitioner, Shri D.P. Thakare, learned Additional GP for respondent No. 1 and Shri S.L. Bodade, learned counsel for respondent No. 2.

2.

Respondent Nos. 1 & 2 are seeking time to file reply. However, it is not in dispute that representation made by the petitioner on 06.04.2017 and similar other representations are still pending with respondent No. 1. 3.

The grievance of the petitioner is, while effecting recruitment to next higher category, 10% quota is prescribed for Gram Panchayat staff. Thus, those higher posts are still not filled in by promoting Gram Panchayat staff.

4.

Shri Warulkar, learned counsel submits that since 2013, position has not changed.

0310wp4508.17 5.

In this situation, we find that interest of justice can be met with by directing respondent Nos. 1 & 2 both, to look into the grievance of the petitioner as per law. 6.

Hence, without observing anything on merits of the controversy, we direct respondent Nos. 1 & 2 to decide the pending representations within a period of three months after communication of this order to them.

7.

Accordingly, writ petition is thus partly allowed and disposed of. However, there shall be no order as to costs.
