The petitioner seeks benefits of direction issued by the holding Company of respondents namely Coal India Limited. Respondents have come up with defense that merely because a policy decision is taken by holding Company, it is not binding upon them and they have constituted a Committee to examine its impact.
Advocate Manoj Pillai points out that other subsidiaries have already accepted and acted upon the decision of the Coal India Limited.
Leaving all contentions of petitioner opens, we direct respondents through said committee to take appropriate decision on controversy within three months from the date of communication of this direction to that Committee.
The direction shall be communicated to the Committee by respondent No. 1.
With this, we dispose of writ petition. No costs. Judge Judge Gohane
