The applicant is arrested on 11th November, 2016 in connection with crime registered against him and two others for the offences punishable under Sections 20(c), 25 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985. The accusations against the applicant are that 21.660 kg. Ganja is seized from his Scooter.

The learned advocate for the applicant has submitted that the applicant is falsely implicated. It is pointed out that co-accused Kudrat Khan is released on bail as per the order passed by this Court in Criminal Application (BA) No.382 of 2017 on 22nd June, 2017. It is further submitted that the investigation is complete, charge-sheet is filed and the Investigating Agency has not been able to point out that further custody of the applicant is required for investigation.

2 ba622.17 The applicant, aged about 29 years, claims to be doing private work/job and has stated that he is not involved in any other crime/offence.

Considering the facts of the case, following order is passed :

The applicant having been arrested in connection with Crime No.6042 of 2016 registered by the non-applicant, he be released on bail on executing P. R. Bond for Rs.50,000/- and on furnishing two solvent sureties each for Rs.25,000/-.

The applicant shall regularly attend the trial before the Special Court on every date unless granted exemption by the Special Court.
