The present application is filed for transfer of Petition No.65/2021 pending before the learned Family Court, Akola to learned Family Court, Amravati. It is submitted that applicant is legally wedded wife of non applicant and their marriage was solemnized on 04/07/2019 at Amravati. During the stay at matrimonial house, it is alleged that she was treated with cruelty and she suffered various mental as well as physical torture. She was driven out from the matrimonial house. The applicant therefore constrained to leave her matrimonial house and reside at her parents' house at Amravati since 29/10/2019. 3.

The applicant placed on record a pursis informing that Domestic Violence proceeding bearing No.200/2020 is filed against the non-applicant. As such the non applicant is required to attend the same.

The application is strongly opposed by the non-applicant. However considering the reasons stated in the application, it would be difficult and inconvenient to the applicant to attend attending the matter at Akola. Hence, it will be proper to transfer the said proceeding pending before the learned Family Court, Akola to Family Court, Amravati. Accordingly I pass following order:

O R D E R

i) Application is allowed.

ii) Petition bearing A Petition No.65/2021 pending before Family Court, Akola is hereby withdrawn and transfer to Family Court Amravati. iii) Learned Principal District Judge, Family Court, Akola is requested to facilitate the transfer. The application is disposed of accordingly.
