Heard Ms.P.N. Lakhani, learned counsel for the applicant-wife, who wishes that the proceedings filed by the non-applicant- husband under Section 9 of the Hindu Marriage Act at Akola be transferred to Hinganghat on the ground of the inconvenience. 2.
Before filing the proceedings under Section 9 of the Hindu Marriage Act, it appears that there were exchange of notices from both the sides. As on today, no proceeding was filed by the applicant-wife for divorce. The non-applicant-husband wants cohabitation with the applicant-wife. Only inconvenience cannot be the ground for transfer of the proceeding from one Court to another Court. Much more has to be demonstrated than mere inconvenience for the transfer. Nothing that sort is made out in this application. Hence, the application is rejected.

However, it is made clear that if the applicant-wife is filing application under Section 24 of the Hindu Marriage Act in the proceeding, the said application will be decided expeditiously by the learned Judge in accordance with law.
