The misc. civil application seeks restoration of the first appeal. The respondent nos.4 to 6 are served. The respondent nos.1 to 3 are deleted. The first appeal stands abated against the respondent no.7.

Considering the reasons given in the application, the same is allowed. The first appeal is restored to its original file.

FIRST APPEAL NO.472/2001 1.

A pursis has been tendered across the bar by the learned counsel for the appellant, which is under the signature of the appellant, by which the appellant does not wish to prosecute the appeal and withdraws it unconditionally. 2.

The pursis is accepted and marked as "X" for the purpose of identification. The first appeal is therefore dismissed as withdrawn.
