In a case under Section 138 of the Negotiable Instruments Act that was filed in the year 2009, the petitioner-accused applied for referring the documents to handwriting expert vide Exh.-77 that was filed on 13.01.2015. The trial Court has not prevented the petitioner from pursuing his defence but has stated in the impugned order that at later stage, the petitioner would open his defence or would commence is case.

That being so, reserving liberty in favour of the petitioner to apply for referring the documents to the handwriting expert in his defence, the present Criminal Writ Petition No.627/2015 is dismissed. JUDGE kahale
