Submission is, compound wall shown to be damaged/demolished in photographs has been erected by the petitioner. Except for copy of sale-deed, there is no other document to show that it was so erected by petitioner. Copy of sale-deed placed on record is also not legible. Respondents have filed reply pointing out that preliminary investigation and a disputed question not only about ownership, but also about identity of property. The contents of paragraph 6 of reply-affidavit filed on behalf of respondent no.3 show the same. After this affidavit-reply filed by respondent no.3, dated 15th September, 2014, the petitioner moved application seeking leave to join additional parties and has also

wp.621.14 2/2 tendered additional affidavit. However, the facts have not been clarified by him even at that juncture.

As such, we find no case is made out warranting interference in writ jurisdiction. With liberty to take suitable steps as are open in the law and keeping the rival contentions open, we dispose of the petition.
