By this petition, the petitioner seeks a direction to the respondent No.1-Scrutiny Committee to decide the caste claim of the petitioner at the earliest. The petitioner also seeks the protection of her education till her caste claim is decided. The petitioner claims to belong to Mana Scheduled Tribes and the caste claim of the petitioner was submitted to the respondent No.1-Scrutiny Committee for verification in January, 2014. The petitioner is admitted in the respondent No.4-College of Engineering. According to the petitioner, though the caste claim of the petitioner is tendered to the Scrutiny Committee for verification in January, 2014, the same has not been decided till date. The petitioner, therefore seeks a direction to the respondent No.

1-Scrutiny Committee to decide her caste claim and the protection of her education till her caste claim is decided. Ms Rane, the learned Assistant Government Pleader appearing on behalf of the respondent No.1-Scrutiny Committee, states on instructions from the concerned Officer of the respondent No.

wp4565.15 2/2 the caste claim of the petitioner is pending and the same would be decided as early as possible.

In view of the statement made by the learned Assistant Government Pleader, we dispose of the writ petition with a direction to the respondent No.1-Scrutiny Committee to decide the caste claim of the petitioner as early as possible and positively within a period of one year from the date of appearance of the petitioner before the respondent No.1-Scrutiny Committee. The petitioner undertakes to appear before the respondent No.1Scrutiny Committee on 07/09/2015 so that issuance of notice to the petitioner could be dispensed with. Since the petitioner was not at fault in not producing the validity certificate, the education of the petitioner protected till her caste claim is decided, meaning thereby that the petitioner should be permitted to appear at the examinations and the results of the petitioner should be declared. Order accordingly. No costs.
