DATE : 3.8.2015 Heard Shri R.D. Karode, learned advocate for the petitioner and Ms. M.N. Hiwase, learned A.G.P. for respondent no.1/Returning Officer.

The petitioner has approached this Court with grievance that her nomination paper has been wrongly rejected on the hyper-technical ground that she has not annexed the proof along with her nomination paper to show that her caste claim is pending for verification. It is submitted that as per the notification issued by State Election Commission it is not necessary to submit the proof to show that the caste claim is pending for verification with the Caste Scrutiny

The elections are to be conducted tomorrow i.e. 4th August, 2015. The nomination paper of the petitioner was rejected on 21st July, 2015. There is inordinate delay on the part of the petitioner in approaching this Court. I refuse to entertain the petition in view of the above facts. The petition is disposed of with liberty to the petitioner to avail appropriate remedy, if so advised.
