Apprehension of arrest relates to Crime No.146/2021 registered with the non-applicant - Ashti Police Station, District Wardha for the offence of theft punishable under Section 379 of the Indian Penal Code. It is alleged that the applicant has stolen iron sheets, cement poles, fencing wire, total worth Rs. 9000/- . It appears that there was civil dispute in between the applicant and the informant for which Civil Suit is going on. It reveals that the applicant is perhaps claiming possession of the landed property and claiming to be owner of the property which was allegedly stolen.

Perusal of the reply-affidavit discloses that during interim protection the applicant has

Order aba674.21 attended police station and handed over the alleged stolen material to Investigating Agency. 4.

Having regard to these facts, no substantial reason remains to deny the applicant' s right of liberty. In view of that, following order:- (i) Criminal Application stands allowed.

(ii) Ad-interim order dated 11.10.2021 is hereby made absolute on the same terms and conditions.

(iii) Henceforth, the applicant shall attend concerned Police Station as and when called.
